This Privacy Policy (“Privacy Policy”, “Policy”) describes the personal information collected or processed when you interact with Francesca’s Studio Works, LLC and its affiliates (which we may refer to as “Francesca’s Studio Works,” “we,” “us,” or “our”) including through our Francesca’s Studio Works, LLC website, digital experiences, social media platforms, mobile apps, online or offline events, or one of our other products or services, all of which are part of Francesca’s Studio Works’ Platform (collectively, the “Platform”). It also explains how your personal information is used, shared and protected, what choices you have relating to your personal data, and how you can contact us.

By using the Francesca’s Studio Works Platform, you consent to the information practices described in this Privacy Policy. You may access the Platform through a computer, mobile phone, tablet, console, or other technology, which we refer to here as a “Device.”

1. Personal Information Collection
In order to better provide you with products and services offered, Francesca’s studio Works may collect personally identifiable information that you provide and/or we collect automatically; for example, when you make purchases; contact our consumer services; request to receive communications; create an account; submit comments or content; participate in our surveys, events or contests; or use our Platform. 

Information You Provide Us
Personal information you provide includes your:

  • Contact details including name, email, telephone number, and shipping and billing address;
  • Login and account information, including screen name, password and unique user ID;
  • Personal details including date of birth and purchase history;
  • Payment or credit card information;
  • Correspondence, comments, images, photos and videos;
  • Personal preferences including your wish list as well as marketing preferences; and
  • Search queries.

        Information Collected Automatically
        When interacting with our Platform, certain information is automatically collected from your Device, browser, or applications (apps), as further described below in the section titled “7. Cookies, Tags, Tracking Pixels and Similar Technologies.” This information includes:
        • Device identifier and Device type, call state, and network access; and
        • Unique cookie identifier and information obtained through cookies; IP addresses; domain; referrer headers; browser type, version and language; operating system and system settings; country; time zone; access times; log files; Web beacons; tags; tracking pixels; and interactions with our Platform such as click behavior, purchases and indicated preferences.

               2. Children Under Thirteen
              Francesca’s Studio Works does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen you must ask your parent or guardian for permission to use our Platform.

               

              3. Use of Personal Information
              Francesca’s Studio Works collects and uses your personal information to/for:

               

              • Deliver the products and services you have requested. When you use our Platform, we will use your personal data to provide the requested product or service. For example, if you make a purchase on francescasstudioworks.com, or participate in an event or promotion, we will use the contact information you give us to communicate with you about the purchase, event or promotion. If you contact our customer support, we will use information about you, such as delivery or payment information, or the product you have purchased to help you resolve a problem or question.

              • Communicate information about our products, services, and for other promotional purposes. If you are an existing customer of Francesca’s Studio Works (for example, if you have placed an order with us), we may use the contact details you provided to send you marketing communications about similar Francesca’s Studio Works’ products or services, where permitted by applicable law (unless you have opted out). We may use the information that you provide to us as to personalize communications and advertisements regarding our products and services that may be of interest to you.  For registered users, this may include data collected from your interactions with our Platform that are associated with your account across Devices.

              • Operate, improve and maintain our business, products, services and Platform. We use the personal information you provide to us to operate our business.  For example, when you make a purchase, we use that information for accounting, audits and other internal functions.  We may use personal information about how you use our products and services to enhance your user experience and to help us diagnose technical and service problems and administer our Platform.

              • Protect our or others' rights, property or safety. We may also use personal information about how you use our Platform to prevent, detect, or investigate fraud, abuse, illegal use, violations of our Terms of Use and to comply with court orders, governmental requests or applicable law.

              • General research and analysis purposes. We use information about how our visitors use our Platform to understand customer behavior or preferences.  For example, we may use information about how visitors to francescasstudioworks.com search for and find products to better understand the best ways to organize and present product offerings on our Platform.

              • Creation of De-Identified Information. We may create De-Identified Information from your personal information by excluding the specific personal information (such as your name) that makes the information personally identifiable to you. We may use this De-Identified Information to analyze request patterns and usage patterns so that we may enhance our products and services. We may also use De-Identified Information to enhance our marketing efforts to potential customers. As this De-Identified Information does not identify you, we may use and disclose De-Identified Information to other parties at our discretion. For purposes of this Privacy Policy, “De-Identified Information" means information that is no longer associated with you or linked to your personal identifiable information. De-Identified Information does not refer to the identity of individual person.

                            4. Disclosure of Information

                            Francesca’s Studio Works may share each of the categories of personal information we collect in accordance with this Privacy Policy with the following entities for the following purposes:


                            • Service providers processing personal information for: business purposes on Francesca’s Studio Works’ behalf, for example to process credit cards and payments; process shipping and deliveries; host, manage and service our information; distribute emails; conduct research and analysis, marketing and advertising, and analytics; manage brand and product promotions; and administer certain services and features. 

                            • Other third parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) prevent illegal uses of our Platform or violations of our Platform's Terms of Use and our policies; (iii) defend ourselves against third party claims; and (iv) assist in fraud prevention or investigation (e.g., counterfeiting). 

                            • To any other third party where you have provided your consent.

                              We may also transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets.

                              We do not sell your personal information.

                              5. Social Networking and Social Sharing Features
                              The Platform may offer social sharing features or other integrated tools such as Instagram, Facebook, Pinterest, Threads, TikTok and YouTube, which let you share actions you take on the Platform with other media, and vice versa.  The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. The fact that we link to or provide integrated tools for sharing with social media sites is not an endorsement, authorization or representation of our affiliation with that social media site, nor is it an endorsement of their privacy or information security policies or practices.  For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the third parties that provide these features.

                              Please keep in mind that when you directly disclose personally identifiable information or personally sensitive information using such social features or other integrated tools on our Platform, this information may be collected and used by others.

                               6. Information Security, Retention and Management

                              Encryption and Security
                              Francesca’s Studio Works endeavors to safeguard your personal information to ensure that such personal information is protected from loss, theft, unauthorized access, use, disclosure or alteration. We use a variety of technical, administrative, and organizational security measures, including encryption and authentication tools in certain circumstances, to maintain the safety of your personal data. 

                              Unfortunately, no data transmission over the Internet or any wireless network or ecommerce solution, platform, website, mobile application, database or system can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that there are security and privacy limitations inherent to the Internet which are beyond our control; and that security, integrity, and privacy of any and all information and data exchanged between you and us through www.francescasstudioworks.com cannot be guaranteed. You can help keep your personal information safe by taking reasonable steps to protect it against unauthorized disclosure or misuse.

                              Information Retention
                              Francesca’s Studio Works retains your personal data for as long as necessary to fulfil the purposes described in this Policy, unless otherwise required or permitted by law.  

                              Information Management
                              You may have the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data; (iii) correction of your personal data if it is incomplete or inaccurate; or (iii) deletion or restriction of your personal data in certain circumstances as provided by applicable law. We will not discriminate against you based solely on your exercise of these rights.  If you request to delete your account, you can create a new account on our Platform at any time.

                              Rights to Deletion
                              Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

                              • Delete your personal information from our records; and
                              • Direct our service providers to delete your personal information from their records.

                                Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

                                • Complete the transaction for which the personal information was collected; perform a contract between us; fulfill the terms of a product recall conducted in accordance with federal law; provide a good or service requested by you; or as reasonably anticipated within the context of our ongoing business relationship with you;
                                • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity and/or prosecute those responsible for those activities;
                                • Debug, identify and repair errors that impair intended functionality;
                                • Exercise free speech, ensure the right of another consumer to exercise his or her right to free speech, or exercise another right provided for by law;
                                • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
                                • Comply with legal obligations; or
                                • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

                                  You can also request removal of your posted user-generated content on the Platform, but please note that removal may not encompass all possible locations, for example, back-ups or sharing by other users initiated prior to removal.

                                  Communication Management
                                  If you have an account with Francesca’s Studio Works, you can opt-out of receiving marketing communications by modifying the preferences in your account settings.  Alternatively, you can opt-out by following the unsubscribe instructions in the communications we send you, by contacting us via our website here or by emailing us at support@francescasstudioworks.com.

                                  7. Cookies, Tags, Tracking Pixels and Similar Technologies
                                  The Francesca’s Studio Works Platform may use “cookies,” tags, tracking pixels and similar technologies to help you personalize your online experience.

                                  We use cookies and pixel tags to track usage of the Platform, to understand our customers’ preferences (such as country and language choices), and as a convenience feature to save you time, all of which enable us to provide services to our customers and to improve their online experience. We also use cookies and pixel tags to obtain aggregate data about Platform traffic and Platform interaction, to identify trends and obtain statistics so that we can improve our Platform. There are generally three categories of cookies used on our Platform:


                                  • Functional: These cookies are required for basic Platform functionality and are therefore always enabled. These include cookies that allow you to be remembered as you explore our Platform within a single session or, if you request, from session to session. They help make the shopping cart and checkout process possible as well as assist in security issues and conforming to regulations.

                                    Please note that we do not recognize or respond to any signal which your browser might transmit through the “Do Not Track” feature on your browser. If you wish to disable cookies on our Platform you should not rely on any “Do Not Track” feature your browser might have.

                                     8. E-mail Communications
                                    From time to time, Francesca’s Studio Works may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from Francesca’s Studio Works and/or when you click on a link therein.

                                    9. External Data Storage Sites
                                    We may store your data on servers provided by third-party hosting vendors with whom we have contracted.

                                    10. Privacy Policy Changes
                                    Francesca’s Studio Works reserves the right to update and change its Privacy Policy as applicable law and our practices change over time. We will post Privacy Policy changes on our Platform. If we materially change the way in which we process your personal data, we will notify you by sending a notice to the primary mail or email address (as applicable) specified in your account and/or by placing a prominent notice on our website. We strongly encourage you to read our Privacy Policy and keep yourself informed of our practices. Your continued use of our Platform and/or purchase of our products and/or services available after such modifications will constitute your acknowledgment of the modified Privacy Policy and your agreement to abide and be bound by that Policy.
